Subletting of the premises in MHADA would depend on weather you are a tenant of MHADA or hold the premsies on ownership basis. If the premsies held on tenancy basis, then you will not be entitled to sublet the same without written consent of MHADA.
The Plaintiff in the Partition suit will have to bear the expenses for publication etc., however you could be considered as costs of the suit at the time of passing final decree in such suit. There is no other manner to settle this, other than by mutual agreement. The civil suit for partition is the right way forward.
