Subletting of the premises in MHADA would depend on weather you are a tenant of MHADA or hold the premsies on ownership basis. If the premsies held on tenancy basis, then you will not be entitled to sublet the same without written consent of MHADA.

As per section 194IA of Income Tax Act, the transferee is required to deduct TDS @ 1% at the time of credit of sum to the account of the transferor or at the time of payment of such sum if the total consideration is 50 lakhs or above. This can be done only if your brother agrees to transfer the same in your name. If he does, he can gift you the same using gift deed.
